Kebijakan Smart City Di Indonesia: Suatu Tinjauan Dalam Perspektif Green Constitution

Abstract


Ekosistem perkotaan sering dikaitkan dengan berbagai permasalahan lingkungan dan keberlanjutan. Salah satu solusi potensial adalah penerapan konsep Smart city. Artikel ini bertujuan untuk mengkaji kebijakan Smart City di Indonesia, serta sejauh mana dimana kebijakan tersebut mampu memenuhi hak-hak warga negara dari perspektif green constitution. Penelitian ini menggunakan pendekatan normatif, konseptual, dan konstitusional. Studi literatur dilakukan terhadap bahan hukum yang dianalisis secara deskriptif-kualitatif. Hasil tinjauan menunjukkan bahwa sejumlah kebijakan yang terkait dengan smart city masih bersifat sektoral dan belum berkelanjutan. Diperlukan instrumen hukum yang secara khusus mengatur standarisasi smart city, sehingga tidak ada perbedaan interpretasi atau hambatan teknis dalam penerapannya. Dari perspektif green constitution, konsep smart city sudah sesuai dengan hak konstitusional yang tertuang dalam Konstitusi Indonesia, namun kebijakan yang dibuat masih bertumpu pada inisiatif dan diskresi masing-masing kepala daerah, sehingga belum menempatkan hak warga negara atas lingkungan secara proporsional.
